- Circular 230 Decoded - Your Roadmap to Competence and Compliance

Speaker: Thomas Curtin - Acting Director of the IRS Office of Professional Responsibility

This presentation provides a comprehensive overview of ethical practice before the Internal Revenue Service, focusing on the professional standards, responsibilities, and regulatory requirements outlined in Circular 230. Through an exploration of competence, diligence, compliance procedures, conflicts of interest, practitioner conduct, and the business side of practice, participants will gain a deeper understanding of what it means to uphold integrity when representing taxpayers. The presentation also highlights key practitioner pitfalls, disciplinary provisions, and essential resources issued by the Office of Professional Responsibility (OPR) to support ethical and compliant practice before the IRS.

By the end of this session, you will be able to:

  • Define the role and authority of the Office of Professional Responsibility (OPR) in administering and enforcing the laws and regulations governing practice before the IRS.
  • Identify the core standards of practice under Circular 230, including competence (§10.35), due diligence (§10.22), and rules governing tax return positions (§10.34). 
  • Describe the ethical requirements and limitations placed on practitioners, including rules related to conflicts of interest (§10.29), solicitation (§10.30), fees (§10.27), and return of client records (§10.28). 
  • Recognize common practitioner pitfalls that may lead to disciplinary action and understand the due process framework for OPR enforcement. 
  • Apply standards for accurate submissions, written advice, and professional conduct, including prohibitions against frivolous positions and willful noncompliance. 
  • Evaluate procedures for ensuring compliance with Circular 230 requirements, including responsibilities of individuals with principal authority (§10.36).
